Official Contest Rules

1.       Prize:  Sunny 95, WSNY will award one $500 cash prize every weekday from Monday, April 21 through Friday, May 23, 2008.  At the end of each week, the five daily winners will be entered for the weekly grand prize of Free Gas and Groceries for a Year.  Grand prize winners will be chosen at random and announced each Monday at 7:10AM with Dino and Shawn in the Morning.  Total prize money will not exceed $33,270.

2.       How to win:  People in the Sunny 95 listening area will win by listening to 94.7FM between 9AM and 5:00PM - the Song of the Day Calendar available at Sunny95.com outlines the specific hour - for that weekday’s “Song of the Day” to play in its entirety.  The 95^th caller to (614) 459-WSNY, after that song has begun, will win an instant $500.  The contest will run every weekday with the daily winners entered for the grand prize drawing for Free Gas and Groceries for a Year.  There will be one grand prize awarded at the end of each week for the duration of the contest.  The odds of the daily winners depend on the number of listeners calling in to the studio.  The odds for the grand prize at the end of each week are 1:5. 

3.       Sunny 95 cannot be responsible for a person’s inability to complete the required entry whether due to equipment malfunction or telephone difficulties.  Note: Due to the nature of our programs that are heard online over the Internet, contests heard on the radio station’s Internet audio stream are slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal.  Thus, all contests heard are delayed.  This delay can last for 30 seconds or more.  This means that when WSNY contests are played that require a specific caller to telephone the radio station (such as “caller number 95 when you hear this song”), listeners to the online audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.

4.       Who’s Eligible: Contest is open to any resident of Columbus and the surrounding WSNY listening area aged 18 or over, except employees, their families, officers, directors and stockholders of Franklin Communications, Inc., its parent companies, any other radio station listed in the Columbus, Ohio, BIA FCC Market Definition, or any of the affiliates and agencies involved in the production or distribution of materials for this giveaway. WSNY reserves the right to disqualify any winner if the contest rules have been violated.

5.       Winner’s Release:  Prize winner must present identification and sign a release a)permitting reasonable use of name, voice, likeness, and biographical information and b)releasing sponsors listed in #4, any of the participating companies, their officers, directors, stockholders and employees from any and all claims, liabilities and damages arising directly or indirectly out of award or use of the prizes. In accordance with IRS regulations, any winner receiving prizes(s) valued at $600 or more in a given calendar year will be furnished a copy of IRS Form 1099 (miscellaneous income).  The winner agrees to waive any claim of royalty or right of remuneration for any such promotional use and agree not to appear on, or on behalf of, any other radio or television station for a period of one (1) year after acceptance of prize.

6.       All prizes are to be claimed at the Sunny 95 Studios, 4401 Carriage Hill Lane, Columbus, OH, 43220 within regular business hours.  Winners are required to present a valid article of identification at this time.  All identification submitted to verify a winner is subject to acceptance by Sunny 95, WSNY in its sole discretion.  Identification which is counterfeit, illegible, tampered with or otherwise altered, will not be accepted.  All prizes are to be claimed within two weeks of date of issue unless otherwise noted.  Any prize not claimed within the allotted time period shall remain the sole property of Sunny 95, WSNY.   The 1-year waiting period to play another major Sunny 95, WSNY contest is in effect.

7.       The person who enters to win/claim any prize and the person redeeming the prize must be one and the same, and will be considered the sole and exclusive winner.  Prizes are non-transferable and non-assignable.  Winners will be obligated to sign and return an Affidavit of Eligibility and provide their social security/tax identification number before receiving the prizes.  Failure to comply with any requirement of these terms and conditions will result in the winning entrant being deemed ineligible for award.  All prize winners are responsible for any federal, state and local taxes as well as any additional expenses incurred with use of the prize.

8.       No purchase necessary.

9.       Where applicable; WSNY, affiliates, participating sponsors, their agencies and the like, or any member thereof, makes no claims of merchantability of Prize.  See manufacturer(s) for complete warranty and operating instructions as it pertains to Prize.  Value of free gas for a year was figured from the averages given as of contest creation on 03/24 at http://www.eia.doe.gov/oil_gas/petroleum/data_publications/wrgp/padd_ohio_mini_report.html.   Value of free groceries for a year was figured from the averages given as of contest creation on 03/24 at http://www.fmi.org/facts_figs/keyfacts/?fuseaction=grcryexpenses.

10.    One winner per household, one winner per family for the duration of this contest.  The term family shall include spouses, parents, children, grandparents, grandchildren and cohabiting significant others.

11.    All decisions of WSNY concerning this contest or eligibility are final.

12.    In the event the winner is subject to, or the subject of, any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner, (e.g. garnishment, child support order, judgment, lien and the like), Franklin Communications’ delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be entitled to rely in good faith upon any documents presented by the representatives seeking to collect the prize in lieu of the winner.  Presentation of the prize to such authorized representative or entity shall be deemed as the same as having given the prize directly to the winner.  Franklin Communications, Inc./Saga Communications, Inc. shall not be liable for any claim by winner for damage incidental thereto.
